Welcome to Savolier (“Savolier,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites, products, and services, including any booking pages and messaging we provide (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Services.
1. Eligibility & Accounts
You must be at least 18 years old (or the age of digital consent in your country) to use the Services.
If you create an account, you must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account.
2. Permitted Use
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
Reverse engineer, copy, or create derivative works from the Services.
Interfere with the operation or security of the Services.
Use automated means (scrapers, bots) without our prior written consent.
Upload or transmit viruses, malicious code, or infringing/illegal content.
We may monitor use and suspend or terminate access for violations.
3. Bookings, Payments & Changes
If the Services allow you to book appointments or purchase offerings:
Pricing; taxes. Prices shown exclude applicable taxes and fees unless stated otherwise.
Payment processing. Payments are processed by third-party processors; we do not store full card numbers.
Cancellations/rescheduling. Any timelines, fees, or procedures will be shown on the booking page or confirmation message.
No guarantees. Unless we expressly state otherwise in writing, we do not guarantee outcomes or results.
4. Communications & SMS Terms
By providing a phone number or email, you agree we may send you transactional communications (e.g., account notices, appointment confirmations and reminders). If you opt in to receive SMS, the following apply:
SMS Consent. By opting in on our web form (or other documented method we provide), you agree to receive recurring text messages from Savolier related to appointments and, if you consent, limited promotions. Message and data rates may apply. Message frequency may vary (typically up to 4 msgs/mo unless otherwise stated). Reply STOP to cancel; HELP for help. Consent is not a condition of purchase.
Opt-out/Help. You can opt out at any time by texting STOP. After you opt out, you may still receive necessary transactional messages (e.g., password reset). For help, reply HELP or contact [email protected] or 1-408-539-0240.
Data. We log consent (timestamp, IP, consent text) and use third-party providers and carriers for delivery. Delivery is not guaranteed.
5. Privacy
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and share information. The Privacy Policy is incorporated into these Terms.
6. Intellectual Property
The Services, including all content, software, designs, logos, and trademarks, are owned by Savolier or our licensors and are protected by law. Except for the limited rights expressly granted to you, we reserve all rights.
Feedback. If you provide suggestions or ideas, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.
7. User Content
If the Services allow uploads or submissions (“User Content”):
You represent you have the rights to submit the User Content and that it does not infringe any third-party rights or laws.
You grant Savolier a non-exclusive, worldwide, royalty-free license to host, use, reproduce, modify, and display your User Content to operate and improve the Services.
We may remove User Content that violates these Terms.
8. Third-Party Services & Links
The Services may contain links to or integrations with third-party websites and services. We are not responsible for those third parties or their content, terms, or policies. Your use of third-party services is at your own risk.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVOLIER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT RESULTS WILL MEET YOUR REQUIREMENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVOLIER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU HAVE NOT PAID ANY AMOUNTS).
Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply to the fullest extent permitted.
11. Indemnification
You agree to defend, indemnify, and hold harmless Savolier and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any laws or third-party rights.
12. Suspension & Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you violated these Terms. Upon termination, the rights granted to you end immediately. Sections intended to survive (e.g., IP, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution) will survive.
13. Changes to the Services or Terms
We may modify or discontinue the Services (in whole or part) at any time. We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., by posting to the site or emailing you). The “Last updated” date shows the latest revision. Continued use after changes means you accept the updated Terms.
14. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.
Informal resolution. Before filing a claim, you agree to contact us to try to resolve the dispute informally within 30 days.
Arbitration; class-action waiver (optional). If you want binding arbitration and class-action waiver language included, use the clause below; otherwise delete this subsection or consult counsel.
Binding Arbitration & Class Action Waiver. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally will be resolved by binding arbitration administered by JAMS under its applicable rules. You and Savolier agree to bring claims only in your individual capacities, not as plaintiffs or class members in any class or representative action. The arbitrator may award individual relief only. You may opt out of this arbitration/class-action waiver within 30 days of first accepting these Terms by emailing [email protected] with subject “Arbitration Opt-Out.”
15. International Use
We operate from the United States and do not represent that the Services are appropriate or available in other locations. You are responsible for compliance with local laws.
16. Notices; Electronic Communications
You consent to receive notices and agreements electronically. We may contact you via the email, phone, or address you provide, or by posting to the Services.
17. Miscellaneous
Entire agreement. These Terms and any incorporated policies are the entire agreement between you and Savolier regarding the Services.
Severability. If any provision is unenforceable, the rest remain in effect.
No waiver. Our failure to enforce a provision is not a waiver.
Assignment. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
